In the Netherlands and the EU, effective firestopping is a legal requirement under the Besluit bouwwerken leefomgeving (Bbl). Under CPR (EU) 305/2011, products falling under a harmonized standard or evaluated via ETA (EAD / ETAG 026 route) must be accompanied by a Declaration of Performance (DoP) and CE marking.
Building owners and facility managers carry a continuous legal obligation to maintain all fire safety provisions. This includes safeguarding the integrity of certified firestops and fire compartments — a mandatory condition for occupancy permits and insurance validity.
- Mandatory Compliance: Meeting Bbl and relevant NEN standards is required for construction and occupancy approval.
- Insurance Validity: Post-fire claims may be denied if non-conforming or substandard seals contributed to fire or smoke spread.
- Specific Duty of Care (Bbl): The Bbl imposes a continuous duty on both owners and users/managers to prevent hazardous conditions and maintain fire safety systems; assign an accountable party within FM/governance.
- Liability: Non-conforming seals can result in administrative enforcement (restriction or closure) and, in cases of gross negligence or serious injury, even criminal prosecution (Art. 307/308 Sr; Art. 51 Sr for legal entities).
